Misocare Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Misocare’s AI voice and messaging services (“Services”), provided by Misocare.io (“Misocare,” “we,” “us,” or “our”). By using our Services, you agree to these Terms.

1. Overview of Services

Misocare provides an AI-powered voice and messaging platform that enables businesses to:

  • Answer inbound calls using AI
  • Communicate with customers via voice and messaging channels (e.g., WhatsApp)
  • Schedule and manage appointments
  • Integrate with third-party systems (e.g., Google Calendar, Outlook, Mindbody, Jane)

Misocare acts as a technology provider, not a human receptionist.

2. Eligibility

  • You must be at least 18 years old and legally able to enter into contracts to use the Services.
  • If you are using Misocare on behalf of a business, you represent that you have authority to bind that entity.

3. Account & Responsibilities

You agree to:

  • Provide accurate business and contact information
  • Maintain the confidentiality of your account credentials
  • Ensure that your use complies with applicable laws (including telecommunication and privacy laws)

You are responsible for all activity conducted through your account.

4. Acceptable Use

You agree NOT to use Misocare to:

  • Violate any laws or regulations
  • Mislead or impersonate others
  • Handle illegal, harmful, or abusive content
  • Process sensitive data without proper consent (e.g., medical, financial, or personal data where restricted)

Misocare reserves the right to suspend or terminate accounts that violate these rules.

5. AI Limitations Disclaimer

You acknowledge that:

  • Misocare uses AI systems that may produce errors or incomplete responses
  • The Service is not guaranteed to be 100% accurate or reliable
  • You remain responsible for verifying critical information (e.g., bookings, customer data)

Misocare is not liable for decisions made based on AI-generated interactions.

6. Call Recording & Data Usage

By using Misocare, you acknowledge that:

  • Calls and messages may be recorded, transcribed, and analyzed
  • Data is used to provide, improve, and maintain the Services
  • You are responsible for obtaining any legally required consent from your customers for call recording

7. Third-Party Integrations

Misocare may integrate with third-party services (e.g., Google Calendar, Twilio, WhatsApp, CRM systems). You agree that:

  • Your use of those services is subject to their own terms
  • Misocare is not responsible for third-party outages, failures, or data handling

8. Fees & Payment

  • Services may be billed on a subscription and/or usage basis
  • Fees are non-refundable unless otherwise stated
  • Misocare may update pricing with prior notice
  • Failure to pay may result in suspension or termination of Services

9. Data Ownership

  • You retain ownership of your business data and customer data
  • Misocare processes data only to provide the Services
  • Misocare may use aggregated and anonymized data for product improvement

10. Intellectual Property

All software, technology, and systems underlying Misocare are owned by Misocare. You are granted a limited, non-exclusive, non-transferable license to use the Services.

You may not:

  • Reverse engineer the Services
  • Copy or resell the technology
  • Build competing systems based on Misocare

11. Service Availability

We aim to provide reliable service, but:

  • We do not guarantee uninterrupted availability
  • Maintenance, outages, or third-party issues may occur

12. Limitation of Liability

To the maximum extent permitted by law:

  • Misocare is not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the past 12 months

13. Indemnification

You agree to indemnify and hold Misocare harmless from any claims arising from:

  • Your use of the Services
  • Violations of laws or regulations
  • Misuse of customer data

14. Termination

We may suspend or terminate your access if:

  • You violate these Terms
  • You fail to pay fees
  • Required by law

You may stop using the Services at any time.

15. Governing Law

These Terms shall be governed by the laws of the applicable jurisdiction.

16. Changes to Terms

  • We may update these Terms from time to time.
  • Continued use of the Services constitutes acceptance of updated Terms.
